Welcome to the website and services of Page Technologies, Inc. ("PAGE," "we," "us," or "our"). These Terms of Use ("Terms") govern your access to and use of our website at pagetechnologies.io (the "Site"), the Autosampler hardware, the cloud dashboard, and any related services (collectively, the "Service"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 18 years old and have the legal authority to enter into these Terms on behalf of yourself or the entity you represent. By using the Service, you represent and warrant that you meet these requirements.

2. Account Registration

Certain features of the Service require an account. You agree to provide accurate, current, and complete information, and to keep your account credentials confidential. You are responsible for all activity under your account. Notify us immediately at info@pagetechnologies.io if you suspect unauthorized access.

3. Waitlist & Early Access

Submitting a waitlist request does not guarantee access to the Service. We may accept or decline requests at our sole discretion. Early-access features may be incomplete, subject to change, or discontinued without notice.

4. Permitted Use

You may use the Service only for lawful purposes and in accordance with these Terms. You agree not to:

  • Reverse-engineer, decompile, or disassemble any part of the Service, including device firmware.
  • Circumvent or tamper with security features, access controls, or usage limits.
  • Use the Service to develop a competing product or service.
  • Transmit malware, spam, or any content that is unlawful, harmful, or infringes third-party rights.
  • Resell, sublicense, or redistribute access to the Service without our written consent.
  • Use automated tools (bots, scrapers) to access the Site or Service except as expressly permitted.

5. Hardware & Biosensor Cards

The Autosampler and biosensor cards are designed for use in accordance with the documentation we provide. Improper use, unauthorized modification, or use outside of specified operating conditions may void any applicable warranty and could result in inaccurate readings. PAGE is not liable for decisions made based on data obtained through misuse of the hardware.

6. Data & Intellectual Property

6.1 Your Data

The Service displays processed PPM values derived from raw sensor readings. You retain ownership of the PPM output data generated by your use of the Autosampler ("Your Data"). Raw sensor signals and underlying calibration data are proprietary to PAGE and are not made available to users.

By using the Service, you grant us a non-exclusive, worldwide, royalty-free license to use, process, store, and analyze all data collected by the Autosampler — including raw sensor signals, calibration data, and device telemetry — to (a) provide and display the Service, (b) conduct internal research and development, (c) improve product accuracy, algorithms, and biosensor technology, and (d) generate aggregated, de-identified analytics and datasets.

6.2 Our Intellectual Property

All content on the Site — including text, graphics, logos, software, firmware, hardware designs, algorithms, and documentation — is owned by or licensed to PAGE and protected by intellectual property laws. These Terms do not grant you any rights to our trademarks, trade names, or branding.

7. Third-Party Services

The Service may integrate with or link to third-party platforms (e.g., cloud providers, analytics tools). We are not responsible for the content, terms, or practices of any third-party service. Your use of such services is governed by their respective terms.

8. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT. PAGE DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT SENSOR READINGS WILL BE FREE FROM INACCURACY.

The Service is not intended to replace certified laboratory analysis where regulatory compliance requires it. You are solely responsible for determining whether the Service meets your regulatory and operational requirements.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PAGE AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES — INCLUDING LOSS OF PROFITS, DATA, CROPS, OR BUSINESS OPPORTUNITY — ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS RELATED TO THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU HAVE PAID TO PAGE IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS ($100).

10. Indemnification

You agree to indemnify, defend, and hold harmless PAGE from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from your use of the Service, violation of these Terms, or infringement of any third-party rights.

11. Termination

We may suspend or terminate your access to the Service at any time, with or without cause, upon notice. You may stop using the Service at any time. Upon termination, your right to use the Service ceases immediately. Sections that by their nature should survive termination (e.g., intellectual property, limitation of liability, indemnification) will remain in effect.

12. Governing Law & Dispute Resolution

These Terms are governed by the laws of the State of Arizona, without regard to conflict-of-law principles. Any dispute arising under these Terms shall be resolved exclusively in the state or federal courts located in Pima County, Arizona. You consent to the personal jurisdiction of such courts.

13. Changes to These Terms

We may modify these Terms at any time by posting the updated version on this page. Material changes will be communicated via email or a prominent notice on the Site. Your continued use of the Service after the effective date of any changes constitutes acceptance of the revised Terms.

14. Miscellaneous

  • Entire agreement: these Terms, together with our Privacy Policy, constitute the entire agreement between you and PAGE regarding the Service.
  • Severability: if any provision is found unenforceable, the remaining provisions remain in full force.
  • No waiver: failure to enforce any provision does not constitute a waiver of that provision.
  • Assignment: you may not assign your rights under these Terms without our prior written consent. We may assign our rights freely.
